PROMOTION TERMS AND CONDITIONS

These Terms and Conditions (the “Terms”) govern each giveaway conducted by Sponsor (as defined in Section 1) on Jam City social media channels (each, a “Promotion”).

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN A PRIZE. This Promotion is void where prohibited by law. The Promotion is subject to all applicable laws and regulations. Interpretations of these Terms by Sponsor are final in all matters relating to the Promotion.

1. ELIGIBILITY: Only legal residents of the United States of America or Canada (excluding Quebec) who have reached the age of majority in their state or province/territory at the time of entry are eligible to enter. Directors, officers, and employees of Jam City, Inc. (“ Sponsor ”), its parent companies, affiliates, subsidiaries, divisions, distributors, agents, professional advisors, printers, and advertising, promotional, and marketing agencies (all such individuals and entities collectively referred to herein as the “ Sponsor Entities ”) and the immediate family members of each and persons living in the same household as each (whether related or not) are not eligible to enter the Promotion or win a Prize.

2. ENTRIES: By submitting an entry in the Promotion, you represent and warrant to Sponsor that your entry is wholly original and does not infringe or violate the rights of any person or entity, or any applicable law, rule, or regulation. Violation or breach of these representations or warranties may subject you to penalties and damages under applicable law. ALL ENTRIES BECOME THE PROPERTY OF SPONSOR WITHOUT ANY OBLIGATION OF ATTRIBUTION OR COMPENSATION TO YOU.

3. ENTRY PERIOD AND CRITERIA: Entries must be submitted during the Promotion period specified in Sponsor’s official social media post(s) for the applicable Promotion and must meet the criteria described in those post(s).

4. PERSONAL INFORMATION: Personal information included in your entry shall be held and used by Sponsor for the purpose of conducting the Promotion and shall be handled in accordance with Sponsor’s Privacy Policy. You may read Sponsor’s Privacy Policy at https://www.jamcity.com/privacyandterms/ .

5. PRIZES: The prize(s) for each Promotion (each, a “Prize”) will be as described in Sponsor’s official social media post(s) for that Promotion. No cash alternative or substitution of any Prize will be allowed, except that Sponsor reserves the right in its sole discretion to replace a Prize with one of comparable value if the Prize is unavailable, in whole or in part, for any reason. No more than the advertised number of Prizes will be awarded. All portions of each Prize are non-assignable and non-transferable. All details and other restrictions of the Prize not specified in these Terms will be determined by Sponsor in its sole discretion.

6. WINNER REQUIREMENTS: Each person selected by Sponsor as a winner of a Promotion (each, a “Winner”) must complete any legal documents provided by Sponsor, including a declaration and release, with respect to any Prize and return them as instructed within the time frame specified by Sponsor, or the Prize may be forfeited, in Sponsor’s sole discretion. If a Winner cannot be contacted, is ineligible, fails to claim the Prize in a timely manner, or fails to timely return the completed and executed declaration and release as required, the Prize may be forfeited and an alternate Winner may be selected. Receipt of a Prize by a Winner is conditioned upon compliance with any and all laws and regulations.

7. COSTS AND TAXES: All costs and expenses not specifically described in the applicable social media post, including, without limitation, sales or use tax to be incurred in connection with redemption of the Prize, are solely each Winner’s responsibility. Sponsor shall have no responsibility or obligation to any Winner who is unable to accept or use the Prize in a timely manner.

8. DISQUALIFICATION: ANY VIOLATION OF THESE TERMS BY A POTENTIAL WINNER OR ANY BEHAVIOR BY A POTENTIAL WINNER THAT WOULD BRING THAT POTENTIAL WINNER OR SPONSOR INTO DISREPUTE (IN SPONSOR’S SOLE DISCRETION) WILL RESULT IN DISQUALIFICATION, AND ALL OF THAT POTENTIAL WINNER’S RIGHTS WILL IMMEDIATELY TERMINATE.

9. INDEMNITY AND RELEASE: By entering, you agree to defend (at Sponsor’s option), hold harmless, and indemnify Sponsor and Sponsor Entities, their respective officers, directors, partners, members, shareholders, employees, agents, executors, family members, heirs, and assigns, and each of their respective parent companies, subsidiaries, affiliates, and advertising and promotional agencies from and against any and all liability, damages, or causes of action (however named or described), with respect to or arising out of (i) your participation in the Promotion or (ii) the receipt, redemption, or use of any Prize awarded in the Promotion. You agree to release all rights to bring any claim, action, or proceeding against Sponsor and Sponsor Entities and further covenant not to sue Sponsor or Sponsor Entities and hereby acknowledge that neither Sponsor nor any Sponsor Entity has made, or is in any manner responsible or liable for, any warranty, representation, condition, or guarantee, express or implied, in fact or in law, with respect to the Prizes.

10. PLATFORMS: Each Promotion is conducted on one or more third-party social media platforms, including, without limitation, Facebook, Instagram, and X (each, a “Platform”). No Platform is a sponsor of any Promotion, and no Promotion is in any way sponsored, endorsed, or administered by, or associated with, any Platform. By entering, you release each Platform and its parent companies, affiliates, officers, directors, employees, and agents from any and all liability arising out of or relating to your participation in any Promotion.
